Affidavit of Heirship
An Affidavit of Heirship is a document used to let the public know who the heirs of an estate are. Often this is the only thing a note seller must use to clear an estate. It’s not an official document and it doesn’t determine who the actual owners are. It’s simply a notification to the public that a certain set of circumstances applied to the deceased persons estate. I often see incorrect affidavits cause a cloud on title and lots of problems. I would not suggest drawing up your own affidavit as the ramifications if it’s wrong are numerous and serious.
